ESTIMATES: Our staff is trained and ready to assist you in estimating your material requirements. Estimating assistance rendered by our staff is not guaranteed to complete or meet any specific project requirement or be suitable for the intended use. All estimates are subject to the customer’s final discretion.
PRICES: Prices are subject to change without notice. Internet pricing may vary from in-store pricing. Some items may not be stocked. We reserve the right to correct typographical errors in pricing and content of any printed advertisement or catalog. Unfortunately, there may be times when we cannot honor an incorrect price and, therefore, we reserve the right to cancel any order.
DOWN PAYMENT & DEPOSITS: These payments are required to secure the customer’s obligation to purchase and pay for items which are to be custom ordered, custom fabricated, or placed in lay-a-way. Down payment and deposits are not refundable.
SALES TAX: All sales are subject to Florida State Sales Tax and Local Sales Tax unless a valid tax exemption certificate is presented on the day of the material sale. Local Sales Tax Rates may vary. Once Sales Tax has been collected for material purchases our store American Wholesale Fenceworks, LLC., cannot refund Sales or Local Sales Tax. If the order is shipped out of the State of Florida, it is the purchaser’s sole responsibility to remit any and all state and local taxes due in the state of delivery.
LOADING: It is the sole responsibility of the customer, customer’s agent, or carrier to ensure any vehicle or trailer used to transport material is suitable to safely and legally transport any materials purchased from American Wholesale Fenceworks, LLC. Our staff will ASSIST YOU in loading purchased items which will fit safely inside vehicle or trailer and customer hereby agrees to indemnify and hold harmless American Wholesale Fenceworks, LLC., from any and all damaged or injuries that may occur as a result of loading material into or on an unsuitable vehicle or trailer or improperly securing and/or tying down materials in vehicle or trailer.
LUMBER: All lumber products is a natural product, in which cracks, wane or checking may appear over time. This does not mean that the product is not “on-grade” at time of manufacturing or that the structural integrity has been compromised once these natural events occur. We do offer pre-purchase selection of pickets, posts and rails for a 25% up-charge. All lumber is sold “AS IS” with no warranty or refund.
SHIPPING/DELIVERY: It is the customer’s sole responsibility to be available at time of delivery. The customer or customers representative must be present to receive and unload the shipment of materials. Failure to be available to receive the shipment/delivery will result in re-delivery. Should this occur, customer will be responsible for all re-delivery/shipping charges, but not limited to the original shipping/delivery fee. All shipping of materials will be on a “tailgate basis”, all material will be delivered in bundles or loose pieces beside or behind the delivery truck. It is the customer’s responsibility to move the materials from beside or behind delivery truck. Our trucks are not permitted to leave the street curb unless a suitable driveway is available and only at the instructions of the customer. American Wholesale Fenceworks, LLC., will not be responsible for any property damage or injuries, which occur as a result of customer’s instructions to proceed beyond the street curb. Purchased materials cannot be transported into yards, garages, or any place other than behind or beside our delivery truck. IMPORTANT: Please check your shipment for possible damage or shortage BEFORE SIGNING THE DELIVERY RECEIPT. If you or your representative sign the delivery document and make no notations of shortage or damage, it is assumed that your shipment was received in full and in good condition.
WARRANTY: All product warranties are strictly limited to the warranty provided by the manufacture of the product. American Wholesale Fenceworks, LLC., does not directly warrant or guarantee any product manufactured by another company directly or the purchaser or end user of the product.
PAYMENT: We accept cash, MasterCard, Visa, Discover, American Express and personal and business checks. Checks must have your name or company name imprinted by the bank. You must provide a valid driver’s license or state issued id. Check should be for the amount of the purchase only. We do not accept two party or starter checks. Return checks are subject to Florida law. There is a return check service charge of $25, if the face value does not exceed $50, $30, if the face value exceeds $50 but does not exceed $300, $40, if the face value exceeds $300, or an amount up to 5%.
RETURNS, EXCHANGES & REFUNDS: All sales are final (no returns, exchanges or refunds).
CREDIT: To establish credit account, customer must contact American Wholesale Fenceworks, LLC.
SERVICE CHARGE: All past due balances are subject to service charge of 1 ½% per month (18% annual), or the maximum permitted by law, whichever is less. Should an action be brought to collection any balances past due or other terms hereof, the prevailing party shall be intitled to recover court costs and reasonable lawyer’s costs.
INSTALLATION INDEMNIFICATION: American Wholesale Fenceworks, LLC., is not responsible for the handling or installation of materials sold hereunder. Customer indemnifies and holds American Wholesale Fenceworks, LLC., harmless from all claims, damages and losses (including lawyer’s cost on a full indemnity basis) arising from or related to installation or use of materials sold hereunder.
GOVERNING LAW: These Terms and Conditions shall be interpreted and construed in accordance with the laws of Florida.
